8.2 Notwithstanding the above, the entrepreneur may offer products or services at variable prices linked to fluctuations in the financial market over which the entrepreneur has no influence. This dependency and the fact that prices may be indicative will be clearly stated in the offer.

8.3 Price increases within 3 months of concluding the contract are only permitted if they result from statutory regulations.

8.4 Price increases after 3 months from concluding the contract are only permitted if the entrepreneur has stipulated this and (a) they result from statutory regulations; or (b) the consumer has the right to terminate the contract from the date the price increase takes effect.

Section 10 – Third-Party Links

10.1 Certain content, products and services available via our Service may include materials from third parties.

10.2 Third-party links on this site may direct you to third-party websites that are not affiliated with us. 10.3 We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content or any other transactions made in connection with any third-party websites. Please review the third party's policies and practices carefully before engaging in any transaction. Complaints, claims, concerns or questions regarding third-party products should be directed to the third party.

11.1 If, at our request, you send certain specific submissions (for example contest entries) or, without a request from us, you send creative ideas, suggestions, proposals, plans or other materials, whether online, by email, by post or otherwise (collectively, "comments"), you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments you send us. We are under no obligation (a) to keep any comments confidential; (b) to pay compensation for any comments; or (c) to respond to any comments.

11.2 We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable, or that violates any party's intellectual property or these Terms.

You are solely responsible for any comments you make and their accuracy.

11.4 We take no responsibility and assume no liability for any comments posted by you or any third party.

Section 12 – Import and VAT

12.1 Shipping arrangement: The Customer acknowledges that all goods ordered via this website are shipped directly by a third-party supplier located outside the European Union (EU) and the United Kingdom (UK). The goods do not pass through the entrepreneur within the UK or EU commercial chain.

12.2 Place of supply and VAT exclusion: In accordance with applicable VAT rules (including Articles 32–33 of EU Directive 2006/112/EC and comparable national provisions such as Article 5(1) of the Dutch Turnover Tax Act 1968), the place of supply for VAT purposes is deemed to be the country where transport begins (i.e. outside the EU/UK). Therefore no VAT is charged by the entrepreneur on the sale of these goods, and the prices shown exclude VAT and import duties.

12.3 Customer as importer: The customer acts as the importer of the goods in the country of delivery and is fully responsible for complying with all import formalities.

12.4 Customer responsibility for import charges: The Customer expressly acknowledges and agrees that they are solely responsible for declaring and paying all import charges due when the goods arrive in the destination country, including but not limited to: (a) import VAT at the applicable rate in the destination country; (b) customs duties, taxes or levies; (c) customs clearance fees, brokerage fees or administrative surcharges imposed by customs authorities or the postal service/carrier. These charges are usually collected from the Customer by the delivering postal or courier service before or at delivery. The Entrepreneur is not involved in determining or collecting these import charges.

12.5 No liability for import charges or delays: The entrepreneur is in no way liable for import VAT, duties, taxes or any delays, seizures or non-delivery resulting from the customer's non-compliance. By placing an order, the customer accepts these terms and indemnifies the entrepreneur against any related claims or costs.

Section 13 – Errors, Inaccuracies and Omissions

13.1 Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability.

13.2 We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate, at any time without prior notice (including after you have submitted your order).

13.3 We undertake no obligation to update, amend or clarify information in the Service or on any related website, including pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website should be taken to indicate that all information has been modified or updated.

Section 14 – Prohibited Uses

14.1 In addition to other prohibitions set out in these Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules or laws, or local ordinances; (d) to infringe upon our intellectual property rights or those of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may affect the functionality or operation of the Service, any related website, other websites or the Internet; (h) to collect the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service, any related website, other websites or the Internet.

14.2 We reserve the right to terminate your use of the Service for violating any of these prohibitions.

Section 15 – Disclaimer of Warranties; Limitation of Liability

15.1 We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free, or that the results obtained from using the Service will be accurate or reliable.

15.2 We may remove the Service for indefinite periods or cancel it at any time without notice.

15.3 You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and services delivered to you through it are (except as expressly stated by us) provided "as is" and "as available", without any representation, warranty or condition of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement.

15.4 In no case shall we, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, replacement costs or similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the Service or any products obtained through it, or any other claim related in any way to your use of the Service or any product, even if advised of their possibility. Where some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law.

Section 16 – Return Policy

16.1 The customer has the right to return the product within 14 days of receipt. The customer bears all costs of returning the product. The product must be returned directly to the supplier.

16.2 DropR8 is not responsible or liable for any costs associated with returning the product. The customer agrees to hold DropR8 harmless from any expense or liability related to the return process.

Section 17 – Refund Policy

Any order with a total value above €100 is not eligible for a refund to the original payment method, unless such a refund is required by mandatory provisions of applicable consumer protection law. Where a return is accepted in accordance with our Return Policy, the refund will be issued exclusively as store credit. This store credit is strictly personal, non-transferable, cannot be exchanged for cash and may only be used for future purchases on our website. By placing an order with a total value above €100, the customer acknowledges having read this policy, expressly accepts it and waives, to the extent permitted by applicable law, any claim to a monetary refund.

Section 18 – Indemnification

You agree to indemnify, defend and hold harmless Puppy Christmas and our parent company, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or the documents they reference, or your violation of any law or the rights of a third party.

Section 19 – Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall still be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. This shall not affect the validity and enforceability of any other provisions.

Section 20 – Termination

20.1 The obligations and liabilities of the parties incurred before the termination date shall survive the termination of this agreement for all purposes.

20.2 These Terms are effective unless and until terminated by you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

20.3 If, in our sole judgment, you fail to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice. You will remain liable for all amounts due up to the date of termination, and we may deny you access to our Services (or any part thereof).

Section 21 – Entire Agreement

21.1 Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

21.2 These Terms and any policies or operating rules posted by us on this site or in respect of the Service constitute the entire agreement and understanding between you and us, and supersede any prior or contemporaneous agreements, communications and proposals, whether oral or written (including prior versions of the Terms).

21.3 Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

Section 22 – Governing Law

These Terms and any separate agreements by which we provide you Services shall be governed by and construed in accordance with the laws of the Netherlands.

Section 23 – Precedence of These Terms over the Counterparty's Terms

These Terms take precedence over any terms of the counterparty, including those in orders, invoices or other documents of the counterparty. Counterparty terms that conflict with or deviate from these Terms are expressly rejected unless we have expressly agreed to them in writing.

Section 24 – Precedence of Agreement

If there are contradictions or inconsistencies between these Terms and a specific agreement between the customer and the entrepreneur, the provisions of that specific agreement prevail, and the conflicting provisions of these Terms shall not apply.

Section 25 – Changes to the Terms

25.1 You can review the most current version of the Terms at any time on this page.

25.2 We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.

25.3 Your continued use of or access to our website or the Service following the posting of any changes constitutes acceptance of those changes.
